CANCELLATIONS:

 

For all 'In Stock' items, you may cancel your order any time PRIOR to it being shipped. There will be a 10% cancellation/re-stocking fee for any in-stock items. If your items have already been shipped, we will not be able to cancel your order. 

 

TERMINATION, CANCELLATION AND CHANGES:  For 'Custom Orders', there is a 72 hour Cancellation Period from time of order placement. There is no Cancellation Fee within this 72 hour period. After this 3 day period, all orders in production will incur a 25% Cancellation Fee to cover the cost of any materials, time and labor invested into your order. If you choose to Cancel your order AFTER it has been completed but before it ships, there are two options. 1) We will issue a full refund, however the refund will not be issued until we can re-sell the item. We will exhaust all options to re-sell the item as quickly as possible, however we do not control how quickly it will be re-sold. 2) We will issue a refund immediately, however we will incur the 25% Cancellation Fee. 

 

LEAD TIME: Custom orders hold an 'estimated' production time of 6-8 weeks. This lead time does not include shipping time. This lead time is not promised or guaranteed due to unforeseen circumstances that may be out of our control.  If our lead times are extended due to mitigating factors, this will not negate our 'no cancellation' policy. 

 

RETURNS:  We do not accept or approve returns once your order has been shipped. Items are custom to your needs. We always stand by the quality of our products and you can expect the support of our outstanding customer service through production and delivery of your order. If there is a craftsmanship issue or defect, we will repair or replace the item at our cost within 6-8 weeks. No refunds will be issued in lieu of a repair or replacement. We warranty our work for 2 years from date of delivery. This does NOT include negligence caused by you or a 3rd party, including dents, dings, scratches and product build up due to improper cleaning. 

 

Terms and Conditions:

 

THE ACCEPTANCE OF THE TERMS AND CONDITIONS SET FORTH BELOW CONSTITUTE THE EXPRESSION OF ALL OF THE TERMS OF THIS AGREEMENT AND A COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN BUYER AND Walkers Point Woodworking, LLC, (“Seller”).

 

Unless otherwise approved in writing by Walkers Point Woodworking, LLC, you are permitted and encouraged to electronically copy and print these Terms and Conditions for the sole purposes of personally reviewing and maintaining a record of the Terms and Conditions pertaining to your order.

 

PAYMENT: Payment for Goods purchased hereunder shall be paid in full, order and payment shall be made in U.S. funds unless otherwise agreed to in writing by Seller. Until the Purchase Price and all other sums due pursuant hereto are paid in full, Seller retains a security interest for the materials described on Buyer’s order form (herein sometimes referred to as “Goods”) and in all proceeds of the sold Goods. Any payments made as a 'payment arrangement' and/or 'deposit' under special circumstances are NON REFUNDABLE, unless Walkers Point Woodworking, LLC is unable to finish and/or complete the order for any reason. 

 

WARRANTY. Seller warrants that the Goods manufactured will be free from craftsmanship defects upon delivery to the Buyer, and warranties all items for a period up to 2 years, not including normal wear and tear, negligence by the Buyer or a 3rd party. Our warranty is completely void if any alterations have been made to the item. Keep in mind that you are purchasing hand made items from solid wood products that may show signs of, including but not limited to superficial imperfections, knots or inherent stress fractures and such things should not be construed as 'defective'. Walkers Point Woodworking is not responsible for defects caused by negligent care, including but not limited to excessive moisture or heated conditions. Our products are NOT sustainable in outdoor environments unless otherwise expressed or implied. We will not be responsible for any bowing, expansion or contraction due to any hostile climate environments. Please know and understand Walkers Point Woodworking would never produce or sell a product if we felt the integrity would be compromised in any way.  If any of the Goods are found by Seller to be defective by craftsmanship, Seller at its option will repair or replace such Goods at the Sellers expense (including but not limited to return shipping to and from the seller, labor to repair, and materials needed to repair the Goods). A replacement will be issued at our convenience, usually within 6-8 weeks. The sole purpose of the stipulated exclusive remedy shall be to provide the Buyer with free replacement of defective Goods. The exclusive remedy shall not be deemed to have failed of its essential purpose so long as the Seller is willing and able to replace or repair the defective item. THE FOREGOING WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES EXPRESSED OR IMPLIED INCLUDING THOSE OF MERCHANTABILITY OR FITNESS FOR ANY PURPOSE NOT EXPRESSLY SET FORTH HEREIN. NO AFFIRMATION OF SELLER, BY WORDS OR ACTIONS, OTHER THAN AS SET FORTH IN THIS SECTION SHALL CONSTITUTE A WARRANTY.

 

 

ACCEPTANCE AND TRANSPORTATION. Seller is not responsible for any damage to goods done by a Carrier/3rd Party. All items leave Walkers Point Woodworking, LLC undamaged and in new condition. Upon Buyer’s receipt of shipment, Buyer shall IMMEDIATELY inspect the Goods prior to the Carrier leaving. Unless the Buyer provides Seller with WRITTEN notice or photos of any claim for shortages or defects in the Goods immediately after receipt of shipment, such Goods shall be deemed fully inspected, checked and accepted by Buyer. If Buyer does not inspect the contents of the item(s) immediately, Buyer releases the Carrier of all responsibility to remedy any damage. If damage is not notated on the BOL and photos are not emailed to us immediately, we can not remedy any situation. If your item is damaged and you followed the above directions, we will either offer a monetary reimbursement or replace the item at our cost. No full refunds will be issued by Walkers Point Woodworking, LLC. If you want to pursue a full refund, you must file a Claim with the Carriers insurance company.

PRODUCTION TIMES: All lead times are approximate and are based upon current availability of materials, present production schedules and prompt receipt of all necessary information. Lead times are not guaranteed and are contingent on other factors. Seller will not be liable for any damage, loss, fault, or expenses arising out of delays in production or shipment or other non-performance of this Agreement caused by or imposed by: (1) strikes, fires, disasters, riots, acts of God; (2) acts of buyer; (3) shortages of labor, fuel, power, materials, supplies, transportation or manufacturing facilities; (4) governmental action; (5) subcontract delay; or (6) any other cause or condition beyond Seller’s reasonable control. In the event of such delay or non-performance, Seller may at its option, without liability, cancel all or any portion of this Agreement and/or extend any time upon which performance hereunder is due. Seller reserves the right to cancel an order, without reason at our discretion. By making this purchase you understand and agree to the above.

 

APPLICABLE LAW and DISPUTE RESOLUTION. This Agreement shall be governed by and construed under the laws of the State of Wisconsin and any disputes under this Agreement shall, to the exclusion of all other jurisdictions, be litigated in Federal or State Courts located in Milwaukee County, Wisconsin. The Seller shall be entitled to recover from Buyer its reasonable costs and attorneys’ fees related to any lawsuit or claim by and/or between Buyer and Seller in which Seller is the prevailing party. Seller's liability (Whether under the theories of breach of contract or warranty, negligence or strict liability) shall be limited to replacing or repairing the goods found to be defective by craftsmanship issues. In no event shall the Seller be liable for consequential or incidental damages. In the event the goods are to be replaced due to craftsmanship issues, the Seller will cover the shipping costs in full. The Buyer will be responsible for preparing the item(s) to be return shipped to an acceptable shipping condition according to the company it is shipping through, including but not limited to re-packaging the items in the original packaging, or securing it to the pallet it was shipped on, and giving the item to the transportation company when they arrive to pick up the goods. The Parties hereto expressly agree that Buyer’s sole and exclusive remedy against the Seller shall be for the replacement or repair of defective Goods and that a refund will not be issued in lieu of a replacement, nor shall the buyer pursue a chargeback to obtain a refund fraudulently. Buyer understands that pursuing a chargeback is a breach of contract and Seller will use all means necessary to recover all monies including but not limited to civil action, liens and collections.

 

 

ENTIRE AGREEMENT. This Agreement contains the entire agreement between Seller and Buyer and no statement, correspondence, sample or other term shall modify or affect the terms hereof. Accepting these terms and condition implies that you have thoroughly read and agreed to the listing of the item(s) you purchased.

 

VARIATIONS:

Seller does not guarantee that the size, color and/or style of the Goods purchased herein will be acceptable for Buyer’s specific use and that the Buyer understands that there is a margin of error regarding specifications and/or certain features may need to be changed or altered.  Items pictured in listing may have variations from the actual product you receive, including but not limited to drawer and door knobs, hinges, barn door tracks, number or drawers/doors, sink size/placement, door/drawer size, door/drawer placement, trim pieces, etc. We may have to substitute product brands/styles if the original item ordered is not available. It is buyers responsibility to request schematics for measurement purposes.

 

Colors may vary from any listing photos or completion photos from our website. Please do not rely on the color you see to be exact when it arrives to you, meaning, any color you see on our website can and may vary in color in real time. Computer screens, phone screens, tablet screens, and the lighting conditions on our end can inherently alter the color of a product. Unless you provide us with an exact paint and/or stain color to use, we cannot guarantee the items will arrive as expected. We cannot stress enough to not rely on colors from listing photos.

 

Manufacturing Standards and Tolerances. The Goods that are manufactured are custom, hand-made products that are built-to-order and may have small deviations from the dimensions requested. The seller guarantees that these deviations in sizing will not exceed the following standards:

 

Overall height – +/- 1.00″ measured from the floor to the top

 

Overall width and length – +/- 1.00″ for Goods that can be measured from front to back and side to side

 

Overall width and length – +/- 1.00″ for products with arbitrary measurements

 

Flatness – +/- 0.125″ from the highest point of the surface to the lowest point

 

Squareness – +/- 0.5 degrees (Only applies to products with square/rectangular features)

 

These deviations are not considered a defect, and the buyer agrees to accept the Goods provided no measurements fall outside of the listed deviation guarantees.

 

Walkers Point Woodworking is not responsible for cost of electrical or plumbing modifications needed to accommodate any product. It is the buyers responsibility to ensure the product will fit properly upon arrival. Examples include but are not limited to bathroom plumbing not being compatible with a vanity. Buyer is responsible for requesting a schematic and/or ensuring our products are conducive with their plumbing situation.

 

Walkers Point Woodworking, LLC reserves the right to update these Term and Conditions at any time.
